Report: New Psychiatric Expertise in the Amsteton Incest Case

Joseph F. was sentenced to life imprisonment in the Amsteton incest case and sent to an institution for the mentally retarded. Relatedly, there is apparently new psychiatric expertise. According to yesterday's “Kronen Zeitung” report, expert Heidi Kastner confirmed that the 88-year-old can no longer expect to commit any criminal offenses due to dementia. Additionally, he is physically weak as a result of a few falls.

Based on the report, the man – who changed his name – could be transferred to a regular jail. The move has been subject to legal reviews several times in recent years. In 2022, the Vienna Higher Regional Court (OLG) spoke against it and determined the need for a further stay after the Krems Regional Court had previously decided otherwise.

The man was sentenced to life in prison in March 2009 and sent to an institution for mentally abnormal offenders. Since then, he has been imprisoned in Krems-Stein prison. The prison court – in this case the Krems Regional Court – regularly checks whether the requirements for employment in the prison system are still met. This restriction is required by law.
